I am having a problem with a buyer on ebay. I recently decided to sell off my Tamron and Sigma lenses and go all canon. The lenses were all sharp and nicely constructed (well the sigma anyway) but I just couldn't deal with the slow focusing.
Anyway, I put my beloved Tamron 28-75 2.8 up for sale on ebay. The auction ended Sept 30th and the guy got it for a decent price. He write me back 2 days ago saying I have to return all his money because the lens is defective. I mean come on now, this is OVER A MONTH!!! How can I take that lens back? First off, I know the lens is not defective since I took some awesome shots with it (see below). Second, how do I know he didn't beat the crap out of it for a month? Third, how do I know the problems he is having are not just user error?

So I ask him to send me some sample pics and maybe I can help him with his problems which he refused.
Now he has put in a dispute with paypal and I can not use my paypal account until it is cleared.
Does anyone have any experience with similar paypal disputes?

That is the problem with dealing through PayPal. Once a person puts in a dispute, there is no way around it until settled.
In your ORIGINAL posting of the auction, did you give ANY type of warranty or such on the lens? Just call PayPal and tell them, there was no warranty, implied or other and that the lens left your hands working, and you have photos to prove it and it has been a MONTH and he is wanting his money back.
Always put a clause in your auctions, "All sales FINAL, no warranty/refund of any kind." PayPal will deny a dispute on that grounds, because the seller KNEW he had no recourse before he made the purchase.
If you have a bank account tied to your PayPal account, I suggest you immediately go close it out and get a new one. It maybe a hassel, but it will prevent PayPal from automatically debiting that money for the lens back out of your bank account! I use a seperate bank account on my PayPal profile, that never has more than 25.00 in it.
Bottom line, sometimes these disputes take a while and PayPal is the only clear winner.

Agreed on the bank account.
Paypal tends to side with the buyer. My brother once sold a $4,000 set of Corvette rims and tires to someone on ebay, and the guy said they were "used" instead of new. They were used, but my brother noted the condition as "---" instead of either, in the listing. He did, however, say that he'd had them for a month or so. Paypal said that it was assume that they were new unless clearly stated otherwise. So, he lost half the money and the guy kept the rims. That's two THOUSAND dollars. Sucks, eh?
I use a savings account for my paypal, and since every cent I save goes to gear, there's never anything in there. I think, however, that in your case, paypal will side with you, since the guy has had it a month. That's ridiculous.

I had a dispute with eBay/PayPal but I was the buyer...they sided with me because I was never sent the item and they could not contact the seller (he was not responding). Basically once the dispute is opened they try to contact the seller to get their side, which I'm assuming they've done already. Try explaining to them how long it took for the buyer to contact you about the defective lense, that you believe it was not defective when sold...and maybe start putting an expiration for refunds on your ebay items.
Hope it works out. Let us know...I'm curious to see how it ends.

Man, Now I see where my friend is coming from. He is a big ebay guy, always selling something. He REFUSES to accept paypal, he says they are worst than the government! :)

Well the case has been closed today. Here is the note they left me:
We have completed our investigation of this case. The buyer has notified us that an amicable resolution has been reached. This case has been closed. No further action is required of you at this time.
I guess the jerk cancelled the complaint? Maybe he was just trying to scare me? I dont know....

the best thig you can do is open a bank account only for paypal and only put the money you need in it at the time you need it.
the guy likely realized he had no real claim, so canceled it.
what an ass.

I had to start a dispute on paypal once because after paying for an item, i did not recieve it. I only got part of the money back

I've dealt with a few people like that on ebay. I sold a laptop on ebay over the summer. Upon shipping it out, I got a tracking number for it, and provided the buyer with the number. They ended up filing a complaint with paypal saying they never recieved the laptop. I found out the packaged had been delivered to them a few days ago, and listed that on their complaint to me. Two days later, they retract the complaint. With ebay, it's a give and take with them.

This is why I started the classifieds section. Maybe we will be able to bull, sell, and trade stuff without worrying about stuff like this.

I was selling tix last minute I got stuck with for a Hooters concert.
I emailed the person the day before I still hadn't rec'd the paypal money.
They said oh sorry too short notice. Well I didn't tell you to bid on it.
So I put in a complaint with EBAY. The guy lies says he waited for me I didn't show up at the concert. I had proof of another couple I met there as well & he didn't come.
Didn't matter EBAY closed my account. Not delivering an item. However, they didn't ask for money back isn't that funny.
When I asked them why the guy didn't want a refund, why my email that said he wasn't coming wasn't proof. All I get is a form letter automated response. I lost my money for tickets I had on there for Bon Jovi tix. They just cancelled the auction & won't allow me access. I have a court date in January for a July concert.
EBAY & PAYPAL....suck!!!
